OUTPOUND - When Is An Impounded Vehicle Considered Abandoned?

An impounded car doesn't become “abandoned” simply because its owner hasn't picked it up for a few days. But leave it sitting behind the tow yard fence long enough, and the situation can change from “my car is impounded” to “I may be losing my legal opportunity to recover it.”

That's an important distinction because abandonment isn't necessarily about whether you intend to give up the vehicle. It can be determined by state law, required notices, deadlines and what happens—or doesn't happen—after the vehicle is impounded.

In other words, you don't necessarily have to say, “I abandon this car,” for the process to start moving without you.

The Clock May Already Be Running

After a vehicle is lawfully impounded, the tow company or government agency generally follows procedures established by state and local law. The registered owner and, when applicable, lienholder may be notified about where the vehicle is being held, what is required to recover it and what can happen if nobody claims it.

The amount of time before an unclaimed vehicle can move into an abandoned-vehicle or lien-sale process varies considerably by jurisdiction and circumstances. That's why assuming you have 30, 60 or 90 days can be a very expensive mistake.

The important date isn't the one you think sounds reasonable. It's the deadline that actually applies to your vehicle.

And there's another problem: the bill may continue growing while you're deciding what to do.

What's Happening Why It Matters
Vehicle remains unclaimed Legal deadlines may continue running
Storage days accumulate Amount needed to recover it may increase
Required notices are issued Your response window may be limited
Deadline passes Sale/disposal procedures may move forward
Vehicle is sold You may lose the opportunity to recover it

“I Can't Afford To Get It Out” Isn't The Same As “I Don't Want It”

This is where many owners get trapped. Maybe you absolutely want your car back, but the release amount is already more than you can afford. Maybe you need another paycheck. Perhaps you're arguing with an insurance company, trying to locate paperwork or waiting for someone else to resolve the problem.

Unfortunately, financial hardship doesn't necessarily stop the statutory process or the storage charges.

Waiting can actually reduce your options. A $900 problem can become a much larger problem after additional storage and administrative charges accumulate. Eventually, an older or lower-value vehicle can reach the point where paying everything required to recover it no longer makes financial sense. That's when you need to stop asking only, “How do I get the money to retrieve this car?” and start asking, “What other options do I have before it's too late?”

Don't Accidentally Abandon A Vehicle You Could Have Sold

This is where OUTPOUND may be able to help.

If you don't want, or can't afford to recover an impounded vehicle yourself, don't automatically assume your only choice is to walk away and let the tow yard deal with it.

Depending on the vehicle, ownership documentation, lien status, tow facility and circumstances, OUTPOUND may be able to purchase the vehicle directly from impound.

That could give you another possible exit before accumulating charges and legal deadlines take the decision out of your hands.

The worst time to investigate your options is after receiving notice that the vehicle has already been sold.

If your vehicle is sitting in impound and you're considering leaving it there, contact OUTPOUND.com as soon as possible. Find out what the actual deadline is, what you owe today and whether the vehicle may still have enough value to provide another way out.

An impounded vehicle doesn't wait for you to decide what to do. Neither should you.
